How A New York Sexual Abuse Attorney May Help A Survivor

If you’ve endured something traumatic and life-altering, just thinking about taking legal action can feel overwhelming. But here’s what we want you to know: you are not alone.

With the right legal support, you can begin reclaiming your voice, your safety, and your sense of control. At Survivors Rights, our goal is to connect survivors with experienced sexual abuse attorneys in New York who handle these cases with compassion and skill.

Not every attorney is equipped to take on cases involving deep emotional trauma and legal complexity. You wouldn’t hire a tax lawyer for a medical malpractice case. Similarly, you shouldn’t hire a general practice attorney for something as sensitive as sexual abuse. A dedicated sexual abuse attorney is trained in the nuances of trauma, institutional liability, and the evolving landscape of New York law, including lookbook windows that expand the Statute of Limitations.

When it comes to justice for survivors, It’s not just about financial compensation (although it matters greatly). It’s also about accountability, closure, and support. It’s about surrounding yourself with professionals who make you feel heard, safe, and respected. And if you’re ready to take that first step, we may be able to help with the crucial first step: getting a free case review.

Every Survivor’s Story Counts!

Far too many people miss their chance to pursue justice because they think it’s too late or their story “doesn’t count,” or that an attorney costs too much. But a few seconds is all it takes to learn if you may qualify.

Your information will be kept private and shared only with attorneys who may be able to help. There are no upfront attorney fees. The New York sexual abuse and assault attorneys we work with typically work on a contingency basis, meaning they only get paid if you receive compensation. Any legal fees or case-related expenses will be clearly explained by the law firm before representation begins.

A Survivor’s Rights Under New York Law

New York has made significant legal changes in recent years to support survivors:

  • Child Victims Act (CVA): Enacted in 2019, the CVA extended the time survivors of childhood sexual abuse in New York can file claims. Survivors now have until age 55 to bring a civil suit, and a special β€œlook‑back” window (initially through August 14, 2020, later extended to August 14, 2021) allowed those whose claims were previously time-barred to file regardless of age.

  • Adult Survivors Act (ASA): Enacted in 2022, ASA opened a one-year windowβ€”from November 24, 2022, to November 24, 2023β€”allowing adult survivors whose civil claims were otherwise time‑barred to sue.

  • No Statute of Limitations for First‑Degree Rape: New York removed the statute of limitations entirely for criminal prosecution of first‑degree rape and other serious sex crimes.

  • Civil Lawsuits: Depending on the timing of the abuse and your age at the time, the CVA and ASA may allow you to fileβ€”either now or in the past. Generally, if abuse occurred after the CVA, you have until age 55; and under ASA, qualifying adults had an opportunity to file through November 24, 2023. Speaking with a qualified attorney is your best next step.

  • Mandatory Reporting: New York law requires certain professionals (e.g. teachers, healthcare providers, social workers) to report suspected child abuse. This duty of mandatory reporters supports timely intervention and can influence the gathering of evidence and pursuit of justice.

The Adult Survivors Act (ASA) is New York State legislation enacted in May 2022 which amended state law to allow alleged victims of sexual offenses for which the statute of limitations had lapsed to file civil suits for a one-year period, from November 24, 2022, to November 24, 2023. The act expanded the ability of plaintiffs to sue for sexual assault and unwanted sexual contact in the workplace.

Notable New York Sexual Abuse Lawsuits and Settlements

New York has been the center of several high-profile sexual abuse lawsuits and settlements that have shaped survivor rights:

  • Boy Scouts of America

In 2020, the Boy Scouts of America faced over 1,400 claims from New York State alone as part of its national bankruptcy proceedings. Many involved abuse that occurred during New York-based scouting activities.

  • Catholic Dioceses

In 2021, the Catholic Diocese of Rockville Centre, Long Island filed for bankruptcy after facing more than 200 Child Victims Act claims. In Sept. 2024, the Diocese of Rockville Centre announced a $323 million settlement to resolve sexual abuse lawsuits filed by more than 500 survivors. Other dioceses across New York, including Buffalo (a 2025 settlement resolved claims of more than 800 survivors for $150 million), Rochester, and Syracuse, have paid multi-million-dollar settlements.

  • Columbia University and New York Presbyterian Hospitals

Columbia University reached a $165 million settlement in 2023 for dozens of women abused by OB-GYN Dr. Robert Hadden. In April 2025, Columbia and NewYork-Presbyterian Hospital agreed to a $750 million settlement involving 576 otherΒ  former patients of Hadden, bringing the total civil payouts in his sexual abuse scandal to over $1 billion.

  • New York City Department of Education

Since the passage of the Child Victims Act, NYC schools have paid over $160β€―million to settle more than 150 claims involving past sexual abuse by school staff, marking the largest public‑sector institutional settlement in the state.

These lawsuits reflect the accountability survivors are demandingβ€”and receivingβ€”in New York State.

Time Limits and Tolling Provisions in NY Sexual Abuse Cases

As mentioned above, New York, similar to several other states, has expanded the statute of limitations for sexual abuse and assault cases, enabline survivors to courageously come forward years, or even decades, after the event occurred. Moreover, tolling provisions can extend the deadlines to file a claim. For example:

  • For survivors under 18, the statute of limitations on civil sexual abuse claims typically begins at age 18.

    Β

  • Under the CVA and ASA, one-time look-back windows suspended the statute of limitations to allow previously expired claims to be filed.

    Β

  • Tolling may apply if the survivor was mentally incapacitated, threatened, or if the abuser left the state.

A qualified attorney can help evaluate if tolling applies in your case and whether you still have time to pursue justice.
The vast majority of sexual abuse and assault cases that result in plaintiff renumeration (compensation) are settled before the cases goes to trial.

Filing a Claim Against a Public Entity in NY

If you were sexually abused by an employee of a government-run institution β€” such as a public school, juvenile facility, or city-run hospital β€” you may need to file a Notice of Claim before pursuing a lawsuit.

In most cases, a Notice of Claim must be filed within 90 days of the incident. However, in child sexual abuse cases, New York law allows for exceptions and extensions. Missing this filing window can result in your case being dismissed, so acting quickly is essential.

A qualified New York sexual abuse attorney can help ensure your Notice of Claim is filed correctly and on time, preserving your right to seek justice.

First-degree rape now has no criminal statute of limitations, and civil claims may varyβ€”consult an attorney for clarity on your case.

Yesβ€”New York’s CVA and ASA were designed to allow survivors to bring claims long after the abuse occurred. However, these windows have now closed, so you should consult an attorney right away to determine if you qualify under existing law.

You can still pursue civil action. Criminal conviction is not required for filing a lawsuit in New York; your evidence and testimony still matter.

Many survivors request anonymity, and the court has discretion to grant it. Your attorney will help you request this to safeguard your privacy.

Yes. In New York, you can bring negligence or liability claims against institutionsβ€”such as schools, churches, clubs, or government bodiesβ€”that failed to protect you.

Yes. New York law allows suits against state-run facilities, including foster care and youth institutions. Public-entity notice requirements may apply, so legal guidance is advised.

Each case varies depending on complexity, the institution involved, and whether discovery or trial is required. Your attorney can provide a timeline based on your specific circumstances.
