Judge Tells Uber to ‘Change Its Attitude’ Toward Settlement

The federal judge overseeing thousands of Uber sexual assault lawsuits is putting more pressure on the rideshare giant to make progress toward resolving the litigation.

According to Bloomberg Law, U.S. District Judge Charles Breyer told the company it needed to “change its attitude” toward settlement as the federal multidistrict litigation (MDL) continues to grow.

The comment comes at an important point in the case.

As of Sept. 1, 2026, 4,588 lawsuits were pending in the federal Uber passenger sexual assault MDL, up from 4,397 a month earlier. The litigation is centralized before Breyer in the Northern District of California, where Uber is headquartered.

At the same time, settlement discussions have become more complicated, and the early bellwether trials have produced sharply different results.

Settlement Process Has Hit Some Turbulence

Judge Breyer appointed retired Judge Gail Andler as settlement master to help the parties explore resolution of the cases.

But in July, Andler asked to withdraw from that role.

Breyer granted the request and ordered the parties to submit proposals for how settlement discussions should be managed going forward.

That did not mean settlement efforts had stopped entirely.

Uber has previously told the court that hundreds of federal MDL claims and hundreds more California state cases were already subject to pending settlement agreements.

But no global settlement has been announced for the thousands of remaining claims.

Breyer’s comment suggests the court wants more meaningful progress rather than allowing the litigation to continue indefinitely through case-by-case negotiations and additional trials.

Bellwether Verdicts Have Been Mixed

One reason settlement may be difficult is that the first trial outcomes have produced dramatically different results.

The first California state bellwether ended in October 2025 with jurors finding that Uber had been negligent in its passenger-safety measures but that its negligence was not a substantial factor in causing the assault. The plaintiff received no damages.

The first federal bellwether went very differently.

In February 2026, an Arizona jury awarded a survivor $8.5 million after finding that the driver acted as Uber’s apparent agent.

Then, in April, a federal jury in North Carolina awarded another passenger just $5,000 in the second federal bellwether.

More Trials Could Increase Settlement Pressure

Additional bellwether trials will test how juries respond to different facts and legal theories.

The next federal trial is expected in Texas, with jury selection scheduled for late September and trial set to begin in early October.

Each verdict gives both sides more information about the risks of continuing to trial.

A string of substantial plaintiff verdicts could increase pressure on Uber to pursue a broader resolution.

Defense verdicts or comparatively small awards could have the opposite effect.

For now, the early results remain too inconsistent to establish a clear pattern.
