The ruling, made earlier this month by U.S. Bankruptcy Judge William J. Lafferty III is a setback for the diocese, which filed for bankruptcy more than three years ago as it faced hundreds of sexual abuse claims. For the 345 survivors whose claims are part of the bankruptcy proceedings, the decision means another delay in reaching a financial resolution. But it also means the diocese may have to offer more money or provide stronger evidence supporting its proposed payments before a judge will approve a reorganization plan. Why Did the Judge Reject the Diocese's Bankruptcy Plan? Judge Lafferty found significant problems with the diocese's calculations of its assets and the money available to compensate survivors. Under federal bankruptcy law, a Chapter 11 reorganization plan must satisfy several requirements before it can be approved. One of those requirements is that creditors who don't accept the plan must receive at least as much as they would if the debtor's assets were liquidated under Chapter 7 bankruptcy. The diocese hadn't adequately demonstrated that its plan met that standard. Among the problems identified by the court were unsupported property valuations, questionable assumptions about liquidation expenses and errors in calculating the money available to abuse claimants. In other words, the court wasn't satisfied that the diocese had provided a reliable financial picture showing that survivors would receive what the law requires. The judge didn't rule that the diocese must liquidate its assets or sell its churches. Instead, he found that the financial analysis supporting its proposed reorganization was inadequate, Bloomberg Law reported. Survivors Overwhelmingly Opposed the $180 Million Proposal The diocese's plan called for up to $180 million to fund a compensation trust. Approximately $150 million would come from the diocese, with an additional $30 million potentially contributed by the Roman Catholic Welfare Corporation, an affiliated church organization. However, that additional money wasn't available to every survivor. The judge found that the diocese had improperly included the restricted contribution in its calculations of the overall funds available to abuse claimants. The proposal faced strong opposition from survivors. Of the 345 abuse claimants involved in the proceedings, 331 voted against the plan, according to the court's decision. A committee representing survivors argued that the diocese was attempting to preserve substantial church assets while offering inadequate compensation to people alleging sexual abuse by clergy and other church personnel. The committee submitted a competing proposal in March 2026 that called for approximately $195 million from the diocese. An additional contribution from an affiliated church organization could have increased the proposed total to approximately $314 million, but that larger amount depended on the organization's agreement to participate. The court did not approve the competing proposal. Court Rejects Diocese's Religious Freedom Argument Another important part of the decision concerned whether the Catholic diocese should receive different treatment under bankruptcy law because of its religious mission. The diocese argued that certain financial requirements could interfere with its religious activities and protections under the First Amendment. Judge Lafferty disagreed. He concluded that applying the ordinary requirements of federal bankruptcy law did not improperly interfere with the diocese's religious freedom. The ruling distinguishes between evaluating church-owned property for bankruptcy purposes and ordering the church to sell its religious facilities. The court also rejected allegations that the diocese had pursued its bankruptcy case or proposed reorganization in bad faith. Those findings mean the decision wasn't a blanket rejection of the church's right to reorganize through bankruptcy. Rather, the court determined that the particular plan submitted by the diocese didn't satisfy the financial and legal requirements for approval. Oakland Diocese Bankruptcy Has Continued Since 2023 The Diocese of Oakland filed for Chapter 11 bankruptcy protection on May 8, 2023. The filing followed hundreds of lawsuits alleging childhood sexual abuse by clergy and other church personnel, including claims made possible by California legislation that temporarily reopened filing deadlines for older abuse cases. Bankruptcy protection allowed the diocese to continue operating while attempting to negotiate a collective resolution of the claims. But more than three years later, survivors still haven't received compensation through an approved reorganization plan. The diocese has argued that it must balance compensation for survivors with its ability to continue serving Catholic communities throughout the East Bay. Following the October ruling, Oakland Bishop Michael Barber described the decision as a setback but said the diocese remained committed to fair treatment of survivors and continuing its religious mission. The rejection doesn't end the bankruptcy proceedings or automatically result in a larger settlement. Instead, the diocese and survivors' representatives must continue working toward a plan that satisfies the court's requirements. Judge Lafferty indicated that a different proposal, potentially involving a larger contribution from the diocese, could be possible. That leaves two important questions unresolved: how much money will ultimately be available to survivors, and how much longer will they have to wait? The decision doesn't establish the value of any individual sexual abuse claim. Nor does it guarantee that survivors will receive the amounts proposed in either reorganization plan. What it does establish is that the diocese cannot obtain approval of its bankruptcy plan without demonstrating that the financial terms comply with federal law.
