A new lawsuit accuses the YMCA of Silicon Valley of failing to protect children from sexual abuse after a 10-year-old girl allegedly was abused by a camp counselor during a field trip in Morgan Hill. The lawsuit was filed in Santa Clara County Superior Court on behalf of the child and names the YMCA of Silicon Valley in connection with allegations involving its Mount Madonna branch. The complaint alleges negligent hiring, inadequate staffing and failures in supervision and child-safety practices. Counselor Accused of Abusing Multiple Girls The lawsuit centers on former camp counselor Anthony Joseph Ramon, 25, of Gilroy. According to the complaint, Ramon allegedly sexually touched the plaintiff and other young campers while they were swimming at the Morgan Hill Aquatic Center during a June 30 field trip. The girl’s mother reported the alleged abuse to the Morgan Hill Police Department on July 9, and Ramon was arrested that day. Two additional 10-year-old girls later came forward with similar allegations involving the same field trip. Ramon has since been charged with three felony child molestation counts. The criminal allegations have not been proven in court. Judge Ultimately Denied Bail Ramon was initially released on bail after his first arrest and again after a second child came forward. After a third girl reported alleged abuse, prosecutors again sought to have him held without bail. At a subsequent arraignment, a judge denied bail. Santa Clara County District Attorney Jeff Rosen said public safety should be a central consideration when courts decide whether defendants accused of sexually abusing multiple children should remain in custody. Lawsuit Alleges YMCA Had Prior Warning About Abuse Risks The civil complaint goes beyond the allegations against Ramon. It argues that the YMCA of Silicon Valley already knew that children at its programs could be vulnerable to sexual abuse by employees because of an earlier case involving the same Mount Madonna branch. In 2013, a teacher’s aide at the branch was accused of sexually abusing several girls between the ages of 3 and 6. The employee, Nicolas Lhermine, later pleaded guilty to six counts of lewd or lascivious acts involving a child and possession of child pornography. The new lawsuit argues that the prior case should have prompted stronger safeguards, staffing and supervision. Complaint Alleges Inadequate Supervision According to the lawsuit, the YMCA failed to meaningfully enforce policies designed to protect children from inappropriate sexual conduct. The complaint alleges there were too few adults supervising campers and staff and that inadequate oversight allowed warning signs and misconduct to go unnoticed. Those allegations are central to the lawsuit because the family is not only accusing an individual counselor of abuse. They are also asking whether the YMCA took reasonable steps to prevent foreseeable harm after previously confronting similar allegations at the same branch. The YMCA of Silicon Valley had not publicly responded to the allegations when the lawsuit was first reported. Case Raises Broader Questions About Institutional Responsibility Sexual abuse cases involving camps and youth programs often examine more than what an individual employee allegedly did. They may also involve questions about hiring practices, staff-to-child ratios, supervision, prior complaints and whether an organization changed its policies after earlier incidents. The Morgan Hill lawsuit alleges that the YMCA had prior notice of the risk of staff sexual misconduct yet failed to put adequate protections in place.
