The U.S. Department of Education has opened a federal civil rights investigation into New York City Public Schools over how the district handles allegations of sexual misconduct involving teachers and other school employees. The investigation is being led by the department’s Office for Civil Rights as part of a broader national effort targeting what officials call so-called “pass the trash” practices, situations in which school employees accused of sexual misconduct are allowed to resign, transfer or continue working without adequate disclosure or accountability, Chalkbeat reported. Federal Probe Focuses on Staff-on-Student Sexual Misconduct The Education Department said the new investigations are examining whether school districts complied with federal civil rights obligations when responding to allegations of sexual misconduct involving staff members and students. New York City Public Schools is one of several districts under review. The department also announced investigations involving districts in Colorado, California, Georgia, North Carolina, Missouri, Texas and Virginia. Officials said the initiative is intended to address cases in which educators accused of misconduct were able to remain employed or move to other schools. The federal investigation does not itself establish that New York City schools violated Title IX. The Office for Civil Rights will review how complaints were handled and whether the district met its obligations under federal law. Nearly 2,000 New York School Abuse Claims Cited In announcing the investigation, federal officials cited reporting by The 74 that identified at least 1,973 Child Victims Act complaints naming a school, educator or staff member in connection with alleged childhood sexual abuse. That figure applies to schools across all 62 New York counties and includes public, private, residential and religious schools. Reporting by The 74 also found that school-related cases accounted for more than 18% of the Child Victims Act complaints it reviewed. Its investigation also documented allegations that some school officials had prior knowledge of misconduct, failed to intervene or allowed accused employees to move between schools. NYC Has Paid More Than $160 Million in Child Victims Act Settlements Federal officials also pointed to reporting that New York City had paid more than $160 million to resolve over 150 Child Victims Act cases as of October 2024. Some of those cases reportedly involved educators who remained employed even after settlements were reached. That issue is central to the broader federal concern over whether schools adequately respond when credible allegations are made against employees. New York City Public Schools said it takes abuse allegations seriously, provides support to students, refers allegations for investigation and pursues disciplinary action when appropriate. The district said it is reviewing the federal complaint. Investigation Comes Amid Changes to Title IX Rules The federal probe comes shortly after the Education Department formally restored the 2020 Title IX regulations governing sexual harassment and assault investigations in schools. Those rules set procedures for how schools must notify accused individuals, investigate complaints and resolve misconduct allegations. Supporters say the rules provide stronger due-process protections, while survivor advocates have argued that some provisions make reporting and pursuing complaints more difficult. For New York survivors, the federal investigation adds another layer of scrutiny to longstanding questions about how schools respond to allegations of sexual abuse and whether institutions acted quickly enough when warning signs emerged.
