Pennsylvania survivors of childhood sexual abuse may have to wait even longer for a chance to file civil lawsuits involving abuse from decades ago, The Guardian reported. A proposed constitutional amendment that would open a two-year window for survivors to pursue otherwise expired claims remains stalled in the Republican-controlled state Senate, despite passing the state House in June 2025. With the legislative session ending November 30, the proposal faces another potential setback after years of unsuccessful attempts to expand legal options for survivors. The legislation could affect people sexually abused as children in churches, schools, residential facilities and other institutions who are currently barred from filing lawsuits because of Pennsylvania's statute of limitations. What Would Pennsylvania's Lookback Window Allow? Under the proposed amendment, survivors of childhood sexual abuse would have a two-year opportunity to file civil lawsuits even if the normal legal deadline had already expired. These laws are commonly called lookback windows because they temporarily reopen the courts to claims involving abuse that occurred years or decades earlier. The proposed Pennsylvania measure would allow eligible survivors to pursue claims against alleged perpetrators and potentially institutions accused of enabling or concealing abuse. Several other states, including New York and California, have enacted similar provisions. But Pennsylvania's effort has repeatedly encountered obstacles. House Bill 464 passed the state House by a 138–64 vote on June 9, 2025. The Senate referred the measure to its State Government Committee, where it has remained without a final vote. Why Has the Legislation Stalled? The dispute centers partly on efforts to connect the childhood sexual abuse amendment with an unrelated proposal requiring stricter voter identification rules. Republican Senate leaders have sought to advance the measures together, while Democratic lawmakers have objected to tying the survivors' legislation to election requirements. Gov. Josh Shapiro has criticized that approach, arguing that the proposed filing window should be considered independently. Republican legislative leaders have countered that disagreements over the broader package have contributed to the impasse. The disagreement leaves survivors waiting for legislation that has attracted bipartisan support but has repeatedly failed to complete the legislative process. Years of Delays Follow Pennsylvania Clergy Abuse Investigation Efforts to establish a lookback window gained momentum after a 2018 statewide grand jury investigation documented widespread childhood sexual abuse within Pennsylvania's Catholic dioceses. The report identified more than 300 priests accused of sexually abusing at least 1,000 children over several decades. Investigators also described instances in which church officials concealed allegations, reassigned accused clergy and failed to protect children. In the years that followed, survivors and advocates pushed lawmakers to reopen civil filing deadlines. A constitutional amendment appeared headed toward a statewide referendum in 2021, but an administrative failure prevented the required public notice from being published. That mistake forced supporters to restart the amendment process. Subsequent proposals have also stalled despite repeated votes in the House. Survivor Advocates Say the Delays Have Real Consequences Former Pennsylvania House Speaker Mark Rozzi, who has publicly discussed being sexually abused by a Catholic priest, has been among the most persistent advocates for the legislation. Speaking with Spotlight PA, Rozzi expressed frustration that survivors continue to wait for an opportunity to bring claims in court. He said the legislation would provide a path to pursue accountability not only from perpetrators but also from institutions accused of helping conceal abuse. Rozzi placed much of the responsibility for the latest impasse on Senate Republican leaders while also saying Gov. Shapiro could do more to help negotiate a resolution. For survivors whose claims are already time-barred, the delays are more than a legislative disagreement. Without a lookback law, some may never have the opportunity to ask a civil court to examine what happened or whether an institution should be held responsible. What Happens Next for Pennsylvania Survivors? Pennsylvania's Constitution requires a proposed amendment to pass both legislative chambers in two consecutive legislative sessions using identical language before voters can consider it in a statewide referendum. The current proposal has not completed that process. If lawmakers fail to advance it before the legislative session ends, supporters may need to begin another round of legislative approvals. Even if the amendment eventually reaches voters, the proposed two-year filing window would not take effect unless voters approve it. For survivors, that means the legislation does not currently extend or reopen any expired civil filing deadlines. Pennsylvania lawmakers have until the end of the session to make further progress. Whether they do so remains uncertain. For those who have already waited years to pursue civil claims, another legislative setback could mean an even longer wait.
