A Louisiana woman is suing Apple after her former partner allegedly hid an AirTag inside their 10-year-old daughter's shoe, allowing him to track the woman's whereabouts after she fled an abusive relationship. According to the federal lawsuit filed October 15, the woman's Android phone failed to warn her about the unwanted tracking device until approximately 9 p.m., hours after she picked up her daughter from school. The complaint raises questions about whether Apple's safety features provide timely warnings to people being stalked, particularly those who don't use an iPhone. The case is among a growing number of federal lawsuits accusing Apple of failing to adequately protect consumers from the misuse of its Bluetooth tracking devices. The woman says she left an abusive relationship in 2020 but continued to experience stalking and harassment from her former partner. According to her complaint, she and her daughter were staying at a hotel in October 2024 because the woman was trying to keep their location hidden. On the morning of October 16, her former partner allegedly concealed an AirTag inside the child's shoe before she went to school. The woman later picked up her daughter without knowing the tracking device was accompanying them. She claims her Android phone didn't issue an unwanted-tracking notification until approximately 9 p.m. When she investigated the warning, she discovered the AirTag inside her daughter's shoe. She reportedly dismantled the device in an effort to disable it and contacted police. Lawsuit Questions Apple's Android Safety Alerts Apple introduced AirTags in 2021 to help consumers locate lost belongings through its Find My network. The small devices can communicate with nearby Apple products, allowing their locations to be updated even when their owners are nowhere nearby. Unfortunately, that same technology can be misused to track people without their permission. Apple has introduced several safeguards, including alerts intended to notify users when an unfamiliar tracker appears to be traveling with them. In May 2024, Apple and Google announced a joint industry specification designed to improve unwanted-tracking detection across iOS and Android devices. But the Louisiana woman's lawsuit alleges those protections weren't sufficient to warn her before her former partner could potentially discover her location. Her complaint argues that Apple knew AirTags could facilitate stalking and should have implemented stronger protections against unauthorized tracking. The timing of the Android notification is central to her allegations. The lawsuit doesn't establish that all Android tracking alerts are delayed or that the device malfunctioned. Those are among the questions concerning product safety and Apple's responsibilities that the litigation may address. Woman Alleges Lasting Emotional and Financial Harm The complaint describes how the alleged stalking affected the woman's ability to feel safe. She says discovering the AirTag aggravated psychological injuries associated with her previous relationship and left her fearful that her former partner could locate her again. The woman also alleges that she has repeatedly relocated and stayed in domestic violence shelters to protect herself and her daughter. Her lawsuit seeks compensation for emotional distress and other alleged harms, along with punitive damages and injunctive relief. The claims against Apple include negligence, alleged product design defects and violations of Louisiana consumer protection laws. The woman's former partner is not named as a defendant in this particular lawsuit. Instead, the complaint focuses on whether Apple could have reasonably prevented or reduced the risks associated with misuse of its product. Were You Secretly Tracked With an Apple AirTag? Explore The Apple AirTag Lawsuit Guide → Federal Apple AirTag Stalking Lawsuits Consolidated in California The new complaint arrives as Apple faces coordinated federal litigation involving allegations that AirTags have been used to facilitate stalking, harassment and other misconduct. On October 2, 2026, the U.S. Judicial Panel on Multidistrict Litigation ordered 17 federal actions transferred to the Northern District of California for coordinated pretrial proceedings. This process, known as multidistrict litigation (MDL), allows one judge to oversee the early stages of the cases, including gathering evidence and deciding common legal questions. The lawsuits remain separate, but combining these proceedings can make it easier to address allegations shared by multiple survivors. The decision doesn't mean Apple has been found responsible or that a settlement has been reached. The litigation, known as MDL No. 3199, is assigned to U.S. District Judge Noël Wise. Additional related lawsuits have since been transferred into the proceeding. The lawsuits generally allege that Apple's product design and safety warnings failed to adequately address foreseeable risks of unwanted tracking. Consolidating these cases allows the federal court to coordinate discovery and address legal questions shared by multiple plaintiffs. It doesn't mean the lawsuits have been resolved or that Apple has been found responsible for the alleged stalking. What Happens Next? The Louisiana woman's claims will be considered within the broader federal litigation, where courts will examine allegations concerning AirTag design, unwanted-tracking warnings and Apple's knowledge of potential misuse. For someone trying to escape an abusive partner, even several hours without knowing they're being tracked could have serious consequences. The lawsuit argues that Apple's existing protections didn't provide the warning the woman needed. Whether those alleged shortcomings establish legal liability will be determined as the litigation proceeds.
