Summary: An Uber driver in Tempe is accused of sexually assaulting a passenger during a ride, as nationwide lawsuits and safety data continue to raise concerns about rideshare accountability.

An Uber driver in Arizona has been arrested after police say he sexually assaulted a female passenger during a ride in Tempe, Fox 10 Phoenix reported today.

Authorities identified the driver as 31-year-old Mario Bernal-Hernandez, who is now facing multiple felony charges.

According to court documents, the incident occurred on October 31, when Bernal-Hernandez picked up the woman and instructed her to sit in the front seat, claiming there was not enough room in the back of the vehicle. During the ride, investigators say Bernal-Hernandez sexually assaulted the passenger while the vehicle was still in motion.

Court records state that the woman repeatedly told the driver to stop and said no throughout the encounter. At one point, she allegedly opened the car door in an attempt to escape while the vehicle was moving. Police also allege that Bernal-Hernandez exposed himself to the victim and threw money at her during the ride.

Once the vehicle reached its destination, police say Bernal-Hernandez allowed the woman to exit. She immediately ran toward a nearby bystander and reported that she had been sexually assaulted. The bystander contacted police, but Bernal-Hernandez fled the scene in his vehicle.

Investigators were later able to identify Bernal-Hernandez as the driver involved. Authorities say he eventually turned himself in and admitted to sexually assaulting the woman. He was arrested on December 16 and booked into jail on charges including sexual abuse, kidnapping, indecent exposure, public sexual indecency, and assault. He is currently being held on a $100,000 cash bond. His next court appearance is scheduled for December 23. The victim has not been publicly identified.

Uber Sexual Assault Litigation and Broader Safety Concerns

The Tempe case comes amid extensive nationwide litigation involving sexual assaults allegedly committed by Uber drivers. Thousands of survivors have filed lawsuits against Uber, claiming the company failed to implement adequate safety measures, properly screen drivers, or respond effectively to reports of sexual assault. These federal cases have been consolidated into a multidistrict litigation in the Northern District of California, where early bellwether trials are expected to shape the future of the claims.

Uber’s own published safety reports acknowledge more than 12,000 reports of sexual assaults over a six-year period, including incidents involving nonconsensual sexual contact and rape. Internal records disclosed during litigation suggest the number of safety related incident reports may be significantly higher. Survivors’ lawsuits allege that Uber prioritized growth over rider safety and failed to address known risks despite repeated warnings.
